Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Calima Workforce Solutions Pty Ltd (ABN 54 687 086 666), trading as Plintha (“Plintha”, “we”, “us” or “our”). They govern your access to and use of our website and property-analysis service (the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Important — general information only, not advice

Plintha provides general, factual information and data-driven analysis for research and educational purposes only. It is notpersonal financial product advice, investment advice, tax advice, credit assistance, legal advice, or real-estate-agency advice, and it does not take into account your objectives, financial situation or needs. The scores and verdicts we produce (for example, “Invest”, “Conditional” or “Discard”) are automated, general indicators based on data and assumptions — they are not a recommendation to buy, sell, finance or retain any property and are not tailored to you.

We are not licensed financial advisers and do not hold an Australian Financial Services Licence (AFSL). Nothing in the Service should be relied upon as a substitute for advice from a suitably licensed or qualified professional. Before making any decision, you should do your own due diligence and obtain independent advice from professionals such as a licensed financial adviser, mortgage broker, registered tax agent or accountant, solicitor or conveyancer, and a qualified property valuer and building/pest inspector.

In particular, anything that involves a self-managed super fund (SMSF), trust, company or other financial product may be regulated financial advice that we are not licensed to provide — you must obtain your own licensed advice before acting in those areas.

2. No guarantee of accuracy or outcomes

Our analyses rely on information you provide and on third-party and public data sources, which may be incomplete, inaccurate, or out of date. Outputs involve estimates, modelling and assumptions and may contain errors. We do not warrant the accuracy, completeness or currency of any data or output. We do not guarantee any financial return, performance or outcome. Property markets carry risk, and past performance is not a reliable indicator of future performance.

3. Eligibility and your account

  • You must be at least 18 years old and located in Australia to use the Service.
  • You are responsible for activity under your account and for keeping access to your email and sign-in secure.
  • You agree to provide accurate information and to keep it up to date.

4. Acceptable use

You agree not to:

  • use the Service unlawfully, or to provide your own financial, credit or other regulated advice to third parties without holding the necessary licence;
  • scrape, crawl, reverse engineer, decompile, or attempt to extract our source code, methodology, scoring logic, prompts or models;
  • resell, redistribute, sublicense or commercially exploit the Service or its outputs except as expressly permitted;
  • attempt to access accounts, data or systems that are not yours, probe or test our security, or interfere with or overload the Service;
  • upload content you do not have the right to upload, or that is unlawful or infringing.

5. Plans, credits and payment

We offer a free tier and may offer paid options (such as analysis credit packs and a Pro subscription). Where paid plans are available, prices and inclusions are shown at the point of purchase. Payments are processed by a third-party payment provider. Except where required by law (including the Australian Consumer Law), credits and fees are non-refundable, and credits may expire as described at purchase. Subscriptions renew for the stated period unless cancelled before renewal. We may change prices and plans on reasonable notice; changes do not affect the period you have already paid for.

6. Intellectual property

The Service, including its software, design, content, methodology, scoring system, prompts and the way analyses are produced, is owned by us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the Service and to use the analyses we generate for your own personal property research. You must not reproduce, redistribute, publish, resell or use our outputs to build or train a competing product.

7. Your content

You retain ownership of the information and documents you submit. You grant us a licence to host, process and use that content to provide and improve the Service. You confirm you have the rights necessary to submit it.

8. Third-party services and data

The Service relies on third-party providers and data sources and may link to third-party websites. We are not responsible for third-party content, services or practices, and your use of them may be subject to their own terms.

9. Disclaimers and Australian Consumer Law

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Where our liability for a failure to comply with a non-excludable guarantee can be limited, our liability is limited (at our option) to re-supplying the relevant service or paying the cost of having it re-supplied.

10. Limitation of liability

To the maximum extent permitted by law, and subject to the section above, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profits, savings, opportunity, or data, arising from or in connection with the Service or any decision you make in reliance on it. Our total aggregate liability to you in connection with the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or AUD $100.

11. Indemnity

You agree to indemnify us against reasonable losses, costs and claims arising from your breach of these Terms, your misuse of the Service, or your infringement of any law or third-party right.

12. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if we reasonably suspect misuse or a security risk, or if we discontinue the Service. Provisions that by their nature should survive (including disclaimers, IP, limitation of liability and governing law) survive termination.

13. Changes

We may update these Terms from time to time. We will post the updated version here and change the “Last updated” date. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth of Australia.
